1. What this service is
The Fair Housing Listing Tool ("the Service") is a drafting aid for real estate professionals. It generates draft property listing descriptions and scans text for words and phrases that may raise fair-housing concerns, using a fixed word- and phrase-matching list. It is a writing and review aid only.
2. Not legal advice
The Service does not provide legal advice, and nothing produced by the Service — including generated descriptions, flagged terms, suggested alternatives, and downloadable reports — is legal advice. Use of the Service does not create an attorney–client relationship. For legal questions about a listing, consult a qualified attorney or your managing broker.
3. No guarantee of compliance
The Service does not and cannot guarantee that any text complies with the Fair Housing Act, state or local fair-housing laws, MLS rules, or any other law or rule. The scanner works by matching words and phrases against a stored list. It may fail to flag risky language, and it may flag language that is harmless in context. An empty scan result means only that no listed terms were matched — it is not a statement that the text is compliant, safe, or legal.
4. You are responsible for the final listing
We do not certify legality. You make the final decision about what to publish, and you are solely responsible for the final listing and for compliance with all laws and rules that apply to you, including your conduct outside the Service.
5. Provided "as is"
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
6. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount of fees you paid us for the Service in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for fines, penalties, or legal costs you incur in connection with any listing.
7. Acceptable use
You agree to use the Service only for lawful purposes and only to draft and review real estate listing content. You may not use the Service to produce discriminatory content, to probe or abuse the system, or to resell its output as a compliance certification.
8. Changes to these terms
We may update these terms. When we make a material change, the version number above will change and you will be asked to accept the new terms before using the tool again. Continued use after acceptance constitutes agreement to the updated terms.
