1. Who we are

FairDraft is a product of Rizvex, operated by Haider Ali ("we," "us," or "our"). FairDraft is accessible at fairdraft.rizvex.com. Questions about these terms can be directed to support@rizvex.com.

2. What this service is

FairDraft ("the Service") is a B2B software tool for real estate professionals. It generates draft property listing descriptions and scans listing text for words and phrases that may raise fair-housing concerns, using a deterministic, rule-based word- and phrase-matching engine. It is a text drafting and review aid only — not a compliance certification, legal service, or guarantee of any outcome.

3. Eligibility

You must be at least 18 years old and using the Service for legitimate business purposes related to real estate listing creation. The Service is not intended for personal, non-commercial use. By using the Service, you represent that you meet these requirements and have the authority to accept these terms on behalf of yourself or your business.

4. Not legal advice

The Service does not provide legal advice, and nothing produced by the Service — including generated descriptions, flagged terms, suggested alternatives, and downloadable reports — constitutes legal advice. Use of the Service does not create an attorney–client relationship. For legal questions about a listing, consult a qualified attorney or your managing broker.

5. AI-generated content disclaimer

Portions of the Service use artificial intelligence (including third-party AI models) to generate draft text and suggested replacement wording. AI-generated content may be inaccurate, incomplete, factually wrong, or nonsensical ("hallucinated"), including but not limited to property details, measurements, addresses, and features. You are solely responsible for independently verifying every factual claim in any generated text before publishing it. We make no representation as to the accuracy of AI-generated output.

6. No guarantee of any outcome

The Service does not and cannot guarantee that any text complies with the Fair Housing Act, state or local fair-housing laws, MLS rules, or any other law or rule. The scanner works by matching words and phrases against a stored list. It may fail to flag risky language, and it may flag language that is harmless in context. An empty scan result means only that no listed terms were matched — it is not a statement that the text is compliant, safe, or lawful.

7. Your responsibility

We do not certify listings. You make the final decision about what to publish, and you are solely responsible for the final listing and for compliance with all laws and rules that apply to you, including your conduct outside the Service.

8. Accounts and access

You must sign in with a valid Google or Microsoft account to access the Service beyond the free tier. You are responsible for all activity under your account, including keeping your login credentials secure. We reserve the right to suspend or terminate accounts that violate these terms, abuse the Service, or engage in fraudulent activity, at our sole discretion and without prior notice or refund.

9. Acceptable use

You agree to use the Service only for lawful purposes and only to draft and review real estate listing content. You may not:

• Produce discriminatory content or use the Service to circumvent fair housing law
• Probe, abuse, reverse-engineer, decompile, or attempt to extract the source code, scanning logic, or word lists of the Service
• Access or attempt to access the Service through any means other than the interface and APIs we provide
• Use automated means (bots, scripts, scrapers) to access the Service without our prior written consent
• Attempt to interfere with, disrupt, overload, or impair the Service, including through denial-of-service attacks, excessive automated requests, or exploitation of bugs or vulnerabilities
• Attempt to gain unauthorized access to any account, system, server, or network related to the Service
• Conduct any security testing, penetration testing, or vulnerability scanning of the Service without our prior written authorization
• Resell, sublicense, or represent the Service's output as an official compliance certification or legal opinion

Violation of this section may result in immediate account termination, without refund, and may be reported to relevant authorities where applicable.

10. Rate limiting and service integrity

We may monitor usage patterns and impose rate limits, usage caps, or temporary or permanent restrictions on any account or IP address that we reasonably believe is engaging in abnormal, automated, or abusive usage of the Service, in order to protect the integrity and availability of the Service for all users.

11. Intellectual property

You retain ownership of the property listing text you input and the final listing content you choose to publish. We retain all rights, title, and interest in the Service itself, including the scanning engine, word lists, source code, algorithms, design, and the FairDraft and Rizvex names and branding. Nothing in these terms transfers any such rights to you.

12. Service availability

We do not guarantee that the Service will be available at all times or free from interruption. The Service may be unavailable due to maintenance, updates, third-party infrastructure failures (including but not limited to our hosting, database, or AI providers), or circumstances beyond our control.

13. Provided "as is"

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

14. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount of fees you paid us for the Service in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for fines, penalties, or legal costs you incur in connection with any listing.

15. Indemnification

You agree to indemnify, defend, and hold harmless Rizvex, Haider Ali, and our affiliates, officers, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any listing content you publish, whether or not generated or reviewed using the Service; (c) your violation of these terms; or (d) your violation of any law or the rights of any third party.

16. Force majeure

We are not liable for any failure or delay in performance to the extent caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government action, labor disputes, internet or infrastructure failures, or failures of third-party service providers (including hosting, database, payment, or AI providers).

17. Payment processing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and issues any refund to your original payment method. Refund and cancellation requests are made to us, not to Paddle — see our Refund Policy. For billing questions, contact support@rizvex.com.

18. Refunds

Our refund policy is available at fairdraft.rizvex.com/refund. We offer a 30-day unconditional refund on initial purchases. No explanation required.

19. Governing law

These terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or the courts of competent jurisdiction. Nothing in these terms limits any rights you may have under the consumer protection laws of your country of residence.

20. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire agreement

These terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings, whether written or oral.

22. Changes to these terms

We may update these terms. When we make a material change, the version number above will change and you will be asked to accept the new terms before using the tool again. Continued use after acceptance constitutes agreement to the updated terms.
